These Terms of Service ("Terms") govern your access to and use of the Chatbotz platform, websites, and services (the "Services"). By using the Services, you agree to these Terms.
1) Who We Are
Chatbotz is a product of DND SOFTWARE (PTY) LTD ("Chatbotz", "we", "us").

2) Eligibility
You must be at least 16 years old to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.
3) Accounts
- You are responsible for keeping your login credentials secure.
- You are responsible for all activity on your account.
- You must provide accurate, complete information and keep it updated.
4) Subscriptions, Billing, and Changes
- Paid plans are billed in advance and renew automatically unless cancelled.
- You authorize us (and our payment processor) to charge your payment method for recurring fees.
- Plan changes take effect at the end of the current billing period.
- We may offer free trials; trial details will be shown at signup or checkout.
5) No Refunds
All fees are non-refundable unless we decide otherwise at our sole discretion.
6) Service Limits and Usage
Plans may include limits (e.g., number of chatbots, message volume, or features). We may enforce plan limits, pause features, or require upgrades if limits are exceeded.
7) Customer Content
"Customer Content" includes content you upload, submit, or make available through the Services (e.g., website URLs, documents, chat data, and configurations).
You represent and warrant that you have all rights necessary to provide Customer Content and to grant us the license below.
You grant Chatbotz a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, and process Customer Content solely to provide and improve the Services and to support your use of the Services.
8) Acceptable Use
You agree not to:
- Use the Services for unlawful, harmful, or abusive activity
- Upload malicious code, exploit vulnerabilities, or attempt unauthorized access
- Infringe or violate intellectual property or privacy rights
- Interfere with the Services or attempt to bypass usage limits
We may suspend or terminate access if we believe you violated these Terms.
9) Branding and Attribution
- The "Powered by Chatbotz" attribution must remain visible on all plans except Plus and Enterprise.
- White-labeling is available only on Plus and Enterprise.
10) Third-Party Services
The Services integrate third-party services (e.g., hosting, storage, AI processing, payments, email). Your use of those services may be subject to their terms and privacy policies.
11) Intellectual Property
The Services, software, and related materials are owned by Chatbotz or its licensors. These Terms do not grant you any ownership rights.
12) Confidentiality
Each party may receive confidential information from the other. You agree to protect our confidential information and use it only to use the Services.
13) Disclaimers
The Services are provided "as is" and "as available". We do not warrant that the Services will be uninterrupted, error-free, or meet your requirements.
14) Limitation of Liability
To the maximum extent permitted by law, Chatbotz is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, or goodwill.
Our total liability for any claims arising out of or related to the Services is limited to the amount you paid to Chatbotz in the 12 months before the event giving rise to the claim.
15) Indemnity
You agree to indemnify and hold Chatbotz harmless from claims arising from your use of the Services or your Customer Content.
16) Termination
You may cancel your subscription at any time. We may suspend or terminate your access for non-payment, policy violations, or security risks. Upon termination, your right to use the Services ends.
17) Changes to the Terms
We may update these Terms from time to time. The effective date at the top indicates the latest version. Continued use of the Services after changes means you accept the updated Terms.
18) Governing Law
These Terms are governed by the laws of South Africa, without regard to conflict of law principles.
